One of the fundamental principles emphasized in the works of Imam Ghazali is that a fatwa must be based on solid foundations. Especially when dealing with uncertainties in commercial transactions, it is important to avoid fatwas based on conjecture and trust in the heart’s conscientious guidance. For the correct understanding and application of religious rulings should align with one’s internal accountability. Avoiding suspicious situations is one of the safest steps to take for both living a life consistent with faith and earning a livelihood in business.

Considerations Regarding Interest and Trade

One of the fundamental principles of Islamic economics is the prohibition of interest. Imam Ghazali emphatically warns that money changers should avoid interest when dealing with gold and silver. This applies not only to cash transactions but also to purchases involving food items. Given the variety of types of interest, one must stay away from interest based on nesie (deferred payment) and fadl (increase). In particular, it is important to perform buying and selling in the same assembly when exchanging gold and silver, and to be careful when purchasing minted gold from mints. It should also be remembered that transactions involving changes in the nature of goods or differences in fineness can carry paths of interest.

Salam Contract and Commercial Trust

One of the important tools for facilitating trade in Islam is the Salam contract. This agreement involves undertaking to deliver a specific commodity at a future date. There are ten essential conditions to be observed in a Salam contract. Clearly specifying the characteristics of the goods, ensuring that capital has been delivered to the customer, and providing ease of delivery are important for the validity of the Salam contract. Such arrangements aim to establish an environment of trust in commercial relations and protect the rights of the parties. With the Salam contract, the merchant’s honesty and reliability also come to the forefront, as they take responsibility when making a promise of future delivery.
