ABLUTION MUST BE RENEWED DUE TO KISSING
178 – Aishah (may Allah be pleased with her) narrated: The Messenger of Allah (ﷺ) kissed Aishah (may Allah be pleased with her), and he did not renew his ablution. [146]
179 – Aishah (may Allah be pleased with her) narrated: The Messenger of Allah (ﷺ) kissed one of his wives and went to prayer without performing ablution. Urwa said to (Aisha): Are you the one? She laughed. [147]
Abu Dawud said:
Zayd and Abdulhamid al-Himmanni transmitted it from Sulayman al-A’mash in this manner.
EXPLANATION
This honorable hadith is weak, but because there are sound hadiths that support its meaning, the majority of scholars have maintained the view that touching a woman does not invalidate ablution. Imam Abu Hanifa holds this opinion as well. Other scholars maintain that touching a woman invalidates ablution, citing verse 6 of Surah Al-Ma’idah: "(And if you are ill or on a journey or come from the place of relieving yourselves or have been in contact with women…)” and stating that "contact" in this verse refers to sexual intercourse. Imam Shafi'i holds the view that touching a woman invalidates ablution.
180 – Urwa al-Muzani narrated from Aishah (may Allah be pleased with her) the aforementioned hadith:
Abu Dawud said: Yahya bin Said al-Kattan asked someone to relate to him these two narrations, meaning Habib and A’mash's narration of the hadiths regarding a woman who must renew her ablution for every prayer due to menstrual blood, are weak. He was to convey this information to the people.
Abu Dawud said: It was narrated from Sawaari that he said: The narrator Habib only informed us from Urwa al-Muzani; meaning he did not relate anything to them from Urwa bin Zubayr.
Abu Dawud said: Hamza al-Zayyatt narrated from Habib, who narrated from Urwa bin Zubayr, who narrated from Aishah (may Allah be pleased with her) a sound hadith.
