ABLUTION IS NOT INVALIDATED BY TOUCHING THE PENIS.
182 – It is narrated from Kays's father, Talk (may Allah be pleased with him) that he said: We came to the Messenger of Allah (peace and blessings upon him). A man resembling a Bedouin also came. He said: "O Messenger of Allah! If a person takes ablution and then wipes over an area of private parts, what is your ruling regarding his ablution?" The Messenger of Allah (peace and blessings upon him) said: “He is nothing other than that [the impurity] or a piece of it.” [149]
COMMENTARY
Imam al-A’zam (may Allah be pleased with him) has taken this hadith as a basis, and holds the view that touching the area of private parts does not invalidate the ablution.
Abu Dawud said: This hadith was narrated by Hisham bin Hasan, Sufyan al-Thawri, Shu'ba, Ibn Uyayna, Jarrir ar-Razi, and Muhammad bin Jabir from Kays bin Talk.
183 – It was narrated on the same meaning of the preceding hadith with the same isnad. In the narration of Muhammad bin Jabir, it said (touching the hem of the garment) in prayer.
COMMENTARY
According to this narration, if the hand touches the hem of the garment during prayer, and a question is asked about the state of the ablution, it is reported that the ablution is not invalidated. In other narrations, there is no mention of “in prayer,” but in the narration of Muhammad bin Jabir, the phrase "in prayer" is present.
