JIHAD SECTION · 123 – Renting out an animal in exchange for half the profit a person would earn from it, or in exchange for war booty.
Vasile ibn Aska (may Allah be pleased with him) narrated:
When the Prophet ﷺ called for departure to the campaign of Tabuk, I had left my family and returned immediately. The companions of the Prophet ﷺ had already set out. I was in Medina, and I would shout, "Who will carry someone on a beast in return for a share of the spoils?" An elderly man from among the Ansar said, “If we provide food and drink to him and take turns riding him, does that constitute his share?” I replied, “Yes.” He then said, “Proceed with blessings from Allah.” We set out with a righteous companion. Allah Most High bestowed upon us spoils without fighting. A group of young camels fell to my share. I drove them to my companion. He sat on the hump of one of his she-camels. Then he said, "Drive the camels, some facing away from us and others facing towards us." The elderly man said, “I do not see among these camels anything but good ones.” Vasile replied, “That camel is part of the spoils that I stipulated for you.” The elderly man said, “O young nephew, take your camels; we desired nothing other than your share [of reward in the Hereafter].”
EXPLANATION:
Ukbeten: Riding one after another on a rotational basis.
Kalais: The plural of Kalas, which refers to a young female camel. Ahmad ibn Hanbal and Awza’i said that there is no objection to acting in this manner. Ash-Shafi'i says that riding compensation should be paid to the owner. He does not say it is Sehm (a share).
