Ubayd ibn Firuz, may Allah be pleased with him, narrated:

I asked Bara’ ibn ‘Azib, may Allah be pleased with him, about which sacrificial animals are not permissible.

Bara’ related: The Messenger of Allah, peace and blessings be upon him, stood up among us, and my fingertips were shorter than his fingertips. (He pointed with his finger) and said: “There are four animals whose sacrifice is not permissible amongst the sacrificial animals: a blind animal with evident blindness, an animal with evident sickness, a lame animal as long as it continues to limp, and an animal which has had its bone broken to such an extent that its marrow will not remain.” I said, "I dislike the female animal with a defect."

Bara’ said: Dislike what you dislike (of sacrificing it), but do not forbid it to anyone.

Abu Dawud said: The word “Latunka” is interpreted as meaning ‘without marrow.’

Yezid ibn Zu MIsir, may Allah be pleased with him, said:

I came to Utbah ibn Abd al-Salami and said, “O Abu al-Walid, I went out to acquire sacrificial animals, but I did not find anything pleasing except for one that has lost a tooth.”

I said, "I dislike sacrificing it; what do you say?" He said, "Bring it to me."

I said, "Exalted is Allah! Does it become permissible for you and not for me?" He said, “Yes.”

He said, “You are doubting, and I am not doubting. The Messenger of Allah, peace and blessings be upon him, forbade sacrificing an animal with its ear fallen off to the middle of the ear canal, its horn broken at the base, its eye blind (gone), incapable of walking due to weakness and inability, or one that has a broken leg.”

Ali (may Allah be pleased with him) narrated:

The Messenger of Allah (peace and blessings upon him) forbade us from selecting for sacrifice those that are blind, those whose ears have been cut off at the tips, those whose earbacks have been cut off, and those with torn ears.

Zuhayr said: I asked, “Did he mention one with a broken horn?” He said, "No." I asked, "What is *muqabila*?" He said, "One whose ear has been cut off on one side.” I asked, “What is *mudabara*?” He said, "One whose earback has been cut off.” I asked, “What is *shirka*?” He said, "It is an ear that is half-cut." I asked, “What is *harka*?” He said, "An incision is made in the ear as a mark, and it is called *harka*." [536]

COMMENTARY:

The scholars differed regarding the extent of these defects. According to Abu Hanifa, if more than half of the animal’s ear, tail, and eye are missing, it is not permissible for sacrifice.

According to Imam Malik, if the cut portion is small, it is permissible; if it is excessive, it is not permissible. According to Ishaq bin Rahawaih, if one-third has been cut off, it is permissible; if more than that has been cut off, it is not permissible.

Ali (may Allah be pleased with him) narrated:

The Messenger of Allah (peace and blessings upon him) forbade sacrificing an animal with a cut ear and a broken horn.

Abu Dawud said: The narrator from Jureej is from Basra, Sedust. No one narrates from him except Katada. [537]

COMMENTARY

Tirmidhi said: It is Hasan (good) and Sahih (authentic). According to the Hanafi, Maliki, and Shafi’i schools of thought, an animal with a broken horn may be sacrificed. If the broken horn is bleeding, it is disliked to sacrifice it.

It was narrated to me from Katadah, may Allah be pleased with him, that I asked, “What is the punishment for Said ibn Musayyib?”

He said, "A beast whose ear has been cut off, or more than half of it.”
