Section 17 – What happens to someone who sends a sacrificial animal but remains in their homeland
Aisha (may Allah be pleased with her) narrated:
I used to braid the halters of the Prophet (peace and blessings of Allah be upon him)’s sacrificial camels with my own hands. Then the Prophet (peace and blessings of Allah be upon him) would mark the camels, place halters around their necks, and send them towards the Ka’bah while he remained in Medina. Nothing that was previously permissible to him became forbidden with their departure. [535]
COMMENTARY:
*Kılâde*: This refers to a marking placed around the neck of sacrificial camels or sheep – typically a piece of dyed wool tied so it would not fall down the animal’s throat. After the sacrificial animal is dispatched and marked with *kılâde*, according to Imam al-Shafi'i, it becomes obligatory to enter into ihram. Whether intending for Hajj or Umrah, the Shafi'is and Malikites state that one is not considered to be in a state of ritual purity (*muhrim*) unless they actually perform the *ihram* themselves through the act of dispatching and marking with *kılâde*.
Aisha (may Allah be pleased with her) related:
The Messenger of Allah (peace and blessings upon him) would send his sacrificial animal from Medina.
I used to spin the wool of his sacrificial animal.
The Messenger of Allah (peace and blessings upon him) did not abstain from that which a person in ihram abstains from, even though he had sent his sacrificial animal.
EXPLANATION:
The meaning of "The Messenger of Allah (peace and blessings upon him) would not abstain from that which a person in ihram abstains from, even though he had sent his sacrificial animal" is that sending the sacrificial animal did not render one to be in ihram. He could remain close to his family, wear stitched clothing, and use perfume.
It is narrated from Aisha, the mother of the believers, may Allah be pleased with her, that:
The Messenger of Allah, peace and blessings be upon him, sent his sacrificial animal to the Ka’bah. I spun wool for the sacrificial animal from what we had available at home. Then the Messenger of Allah, peace and blessings be upon him, spent the night among us without ihram. He said, “Do as you do for your families.”
