Section of Divorce · 21 – How long does the option to annul a marriage last for a female slave who has gained her freedom?
Aisha (may Allah be pleased with her) related:
Berira was freed while she was in the custody of Mughis, a slave of the family of Abu Ahmad. The Messenger of Allah (peace and blessings upon him) granted Berira the option [of choice], and said to her, “If your husband approaches you, your option ceases.”
EXPLANATION
The views of Abu Hanifa, Malik, Ahmed bin Hanbal, and Shafi’i are also like this.
If a female slave is freed and then her husband approaches her, the option ends.
Another view of Shafi'i is that the option ends after intercourse.
