Marriage Section · 27 – Equality in Marriage
Abū Hurayrah, may Allah be pleased with him, narrated:
Abū Hind had taken blood from the head of the Prophet, peace and blessings be upon him.
The Prophet, peace and blessings be upon him, said, “O Banū Bayyāzah, marry Abū Hind and let him marry your daughters. If there is any good in what you are treated with, it is that he takes blood.”
COMMENTARY
Abū Hind was a freedman of the Banū Bayyāzah and he took blood. This hadith is an argument for Imām Mālik and those who follow his school of thought. According to Imām Mālik, equivalence in marriage is only in religion; there is no mention of equivalence in other matters.
They say that the Prophet, peace and blessings be upon him, ordering the Banū Bayyāzah to marry Abū Hind, who was not one of them, is evidence that equivalence is only valid in religion. (Mealim al-Sunan, vol. 3, p. 44)
