3362 – It was narrated from Zayd ibn Thābit (may Allah be pleased with him), the father of Ḥajīrah: The Messenger of God (peace and blessings be upon him) granted a concession for transactions conducted by means of ‘ariyya (a specific kind of exchange) involving fresh dates for dried dates. [195]

EXPLANATION

Arāyā: This is the plural of ‘ariyya. ‘Ariyya (a specific kind of exchange): If a person who owns a date orchard gives one of his date palms as a gift (hibah) to someone, and the recipient of this gift is unable to tend to the single palm, he may sell the fresh dates on the tree for dried dates, or for fresh dates that have already been picked from the branch. Alternatively, if someone who possesses dried dates wishes to eat fresh dates in season, he may give the dried dates and receive a quantity of fresh dates sufficient for his needs.

3363 – It was narrated from Sahl ibn Abī Ḥathmah (may Allah be pleased with him): The Messenger of God (peace and blessings be upon him) forbade selling fresh dates for dried dates, but granted a concession for ‘ariyya. This is when the fruit is estimated and sold for an equivalent amount. The owners (who purchase the fresh fruit) consume it fresh. [196]
