SECTION ON JIHAD · 33 – ONE WHO GOES TO BATTLE WITHOUT THE CONSENT OF HIS MOTHER AND FATHER
2528 – It is narrated from ʿAbdullāh ibn ʿAmr (may Allah be pleased with him) that he said: A man came to the Messenger of God (peace and blessings be upon him) and said: “I have come to pledge allegiance to you for hijra (emigration). I left my mother and father weeping.” The Messenger of God (peace and blessings be upon him) said: “Return to them, and make them laugh as you made them weep.” [372]
2529 – It is narrated from ʿAbdullāh ibn ʿAmr (may Allah be pleased with him) that he said: A man came to the Messenger of God (peace and blessings be upon him) and said: “O Messenger of God, may I go out to jihad (struggle in the way of God)?” The Messenger of God (peace and blessings be upon him) said: “Do you have a mother and father?” The man said: “Yes, I do.” The Messenger of God (peace and blessings be upon him) said: “Then strive in their service.” [373]
2530 – It is narrated from Abū Saʿīd al-Khudrī (may Allah be pleased with him): A man had emigrated from Yemen to the Messenger of God (peace and blessings be upon him). The Messenger of God (peace and blessings be upon him) said to him: “Do you have anyone in Yemen?” The man said: “My mother and father.” The Messenger of God (peace and blessings be upon him) said: “Return to them and seek their permission. If they permit you, then go out to jihad. If they do not permit you, then do good to them.”
EXPLANATION
If the battle is a supererogatory (nafl) battle and your mother and father are Muslims, it is not permissible to go to war without their permission. If the battle is an obligatory (fard) battle, then even if your mother and father do not give permission, it is necessary to go. If the mother and father are disbelievers, then whether the battle is obligatory or supererogatory, there is no need for their permission. This is because abandoning war with the disbelievers is an action in favor of the disbelievers.
