JIHAD SECTION · 161 – The Head of State may set aside a portion of the seized spoils for himself.
Amr ibn ‘Abasah (may Allah be pleased with him) narrated:
The Messenger of Allah ﷺ performed the prayer for us behind a she-camel from the spoils of war. When he gave the salam, he plucked a hair from the side of the camel and said, “This hair’s worth is not permissible to me from your spoils of war, except for one fifth. And one fifth is spent on your weapons.”
