Abdullah ibn Mas'ud, may Allah be pleased with him, narrated:

I asked the Messenger of Allah, peace and blessings upon him, "O Messenger of Allah, which sin is the greatest?"

The Messenger of Allah, peace and blessings upon him, said, “To associate partners with Allah when He has created you.” I said, “Then what?”

The Messenger of Allah, peace and blessings upon him, said, “To kill your child out of fear for your provision.” I said, “Then what?”

The Messenger of Allah, peace and blessings upon him, said, “To commit adultery with the wife of your neighbor.” Abdullah ibn Mas'ud said: The Exalted Allah then revealed this verse to confirm the words of the Prophet: "Those who do not worship except their Lord, and they do not kill a soul without just cause, nor do they commit unlawful sexual intercourse; whoever does one of these things will face a penalty." [242] (Surah Al-Furqan, verse 68)

Jabir ibn Abdullah (may Allah be pleased with him) narrated:

A woman named Musayka (may Allah be pleased with her) came to a person from the Ansar and said:

“My master was compelling me to adultery, and then the verse concerning [the prohibition of] forcing female slaves into adultery descended.” (referring to Surah Nur, verse 33).

EXPLANATION:

One manuscript reads “Miskina” instead of “Musayka”. Surah Nur, verse 33 states: "And those who cannot afford a wife should practice chastity until Allah enriches them by His favor. And do not covet that which Allah has given to some of you over others. Do not restrain [from marriage] female slaves whom you own desiring purity, if it is beyond your means; [instead] release them as a favor and obligation. Whoever of you cannot afford [to marry], let him practice chastity until Allah enriches him by His grace. And do not force your slave girls to commit adultery so that they may seek purity, for whoever compels them therein, he has certainly been unjust from his trials; indeed, Allah is an exacting judge and most merciful."

Among the practices of pre-Islamic ignorance was that female slaves would be driven to adultery, and the ill-gotten gains from it were consumed.

Said bin Abi al-Hasan said, "Regarding the verse, 'If anyone forces them [women] to commit immorality, then surely Allah is forgiving and merciful towards them in their being forced,' Allah has explained it regarding the female slaves who were compelled to do that."

The Prophet (peace be upon him) said: "Do not let a woman seek her sister's divorce to reach [her former husband]." What is destined for her will befall her. [165]

The Prophet (peace be upon him) said: “Divorce is the most disliked of lawful things before Allah.” [166]

He divorced his wife while she was menstruating in the early days of Islam. 'Umar bin al-Khattab asked the Prophet (peace be upon him) about its ruling. The Prophet (peace be upon him) said to 'Umar: "Order your son to reconcile with his wife, then wait until she is clean and has another menstrual cycle, then another cleansing. After that, he may either retain her or divorce her without contact." That is the waiting period which Allah, the Exalted, has commanded in a woman’s divorce.” [167]

Ibn 'Umar divorced his wife while she was menstruating, and 'Umar told the Prophet (peace be upon him) about it. The Prophet (peace be upon him) became angry, then said: "Order your son to reconcile with his wife, then wait until she is clean and has another menstrual cycle, then another cleansing. After that, he may either retain her without contact or divorce her while she is clean. That is the waiting period which Allah, the Mighty and Majestic, has commanded.” [168]

Abu Dawud said: Yunus bin Jubayr, Anas bin Sirin, Sa’id bin Jubayr, Zayd bin Aslam, Abu Zuhayr, and Abu Wail narrated from Mansur. Their meaning is the same: The Prophet (peace be upon him) ordered Ibn 'Umar to reconcile with his wife until she was clean. Then he made it permissible for him to either retain her or divorce her. Muhammad bin Abd ar-Rahman also narrated from Salim, who narrated from Ibn 'Umar. But Zuray’s narration from Salim, from Nafi', from Ibn 'Umar is as follows: The Prophet (peace be upon him) ordered Ibn 'Umar to reconcile with his wife until she was clean and then had a menstrual cycle, then another cleansing. Then he commanded him either to divorce her or retain her. [170]

2186 – From Mutarrif bin Abdullah: It was asked of Imran bin Husayn, "What is the ruling if a man divorces his wife and then has intercourse with her without a witness?" He said, “You divorced her in disobedience to the Sunnah, and you returned [to her] in disobedience to the Sunnah. Appoint witnesses for her divorce and her return, and do not divorce or return without witnesses again.” [171]

2187 – It is reported on the authority of Ibn Abbas by Abu Hasan, a slave of Banu Nawfal, that a slave who had a concubine in his marriage divorced his wife twice, then they were freed. Is it permissible for the man to seek his divorced wife? Ibn Abbas replied: "Yes, the Prophet (peace be upon him) judged accordingly." [172]

2188 – This narration is related on the same chain and meaning without the use of an informing report, and in this narration, Ibn Abbas said: “You have a divorce remaining. The Prophet (peace be upon him) judged accordingly.” [173]

Abu Asim said: I narrated from Muzahir. He narrated to me from Qasim. Aishah (may Allah be pleased with her) reported: A similar narration was related from the Prophet (peace be upon him). But in that narration, it was stated: “The concubine’s waiting period is two menstrual cycles.” [174]

The Prophet (peace be upon him) said: "What you have power over does not become permissible by divorce. You cannot free what you do not have power over. You cannot sell what you do not have power over." Ibn Sabbah added, “Vows are not fulfilled except for that which you have power over.” [175]

Abu Dawud said: By "Ghilak," I think he means anger. [176]

The Prophet (peace be upon him) said: "There are three things in which the truth is true, and its jest is also true: marriage, divorce, and reconciliation [after a single divorce]." [177]

Divorced women must wait for three menstrual cycles. It is not permissible for them to conceal what Allah has created for them in their wombs. Indeed, when a man divorced his wife, he had the right to reconcile with her up to three times; this was abrogated, and the verse (Talak twice) was revealed [Al-Baqarah, 299]. [178]

And it has been narrated that Abu Rukana used the phrase "surely" when divorcing his wife, which the Prophet (peace be upon him) considered as a divorce, and he ordered him to reconcile with her. [179]

Is it known to you that in the early days of Islam, during the time of Abu Bakr, and for the first three years of Umar’s caliphate, three divorces were counted as one? Ibn Abbas said: "Yes." [180]

Whose Hijrah is for Allah and His Messenger, then his Hijrah is for Allah and His Messenger. And whose Hijrah is for the world, then it is to what he intends. Or if a woman migrates, she is married to him, and her Hijrah is to that which she migrated for.” [181]

2202 – From Abdullah bin Ka’b bin Malik: He said: I heard Kab bin Malik narrating the story of his experience during the Tabuk campaign: After fifty days had passed, the Prophet's messenger arrived and ordered him to separate from his wife. Malik said: Should I divorce her or what should I do? He replied: No, you should not divorce her, but separate from her and refrain from approaching her. So I told my wife: “Go to your people’s home until Allah decrees a ruling.” [182]

The Prophet (peace be upon him) gave us the choice between divorcing ourselves and preferring Him. We preferred the Prophet (peace be upon him), so this choice was not considered a divorce. [183]

Katadah narrated from Kesir, the freed slave of Ibn Samura, who narrated from Abu Salama, who narrated from Abu Huraira, on the authority of the Prophet (peace be upon him).

2208 – From Abdullah ibn Ali ibn Yazid ibn Rukana, from his father, and from his grandfather is related. Rukana divorced his wife by saying "Indeed," and came to the Messenger of Allah (peace be upon him). The Messenger of Allah (peace be upon him) said, “How many divorces did you intend when you said ‘Indeed’?” Rukana said: I intended one divorce. The Messenger of Allah (peace be upon him) said: "May Allah bless you and grant you peace! Do you swear to Allah that you intended only one?" Rukana swore to Allah. The Messenger of Allah (peace be upon him) said: “Indeed, a divorce with ‘Indeed’ is according to your intention.” [184]

2209 – It has been related from Ayyub that a great number came to him and he was asked about this matter. He stated that he had not narrated it, but rather related it to Katada. Katada said: Yes, I have narrated it, but he has forgotten. [184]

2210 – It has been related from Abdullah ibn Ali ibn Yazid ibn Rukana, from his father, and from his grandfather that Rukana divorced his wife by saying "Indeed," and came to the Messenger of Allah (peace be upon him). The Messenger of Allah (peace be upon him) said, “Give charity to sixty poor people.” I said, "We do not have anything to eat." 2213 – I said, striking my leg, “I have no way out except from this.” The Messenger of Allah (peace be upon him) said, "Observe fast for two consecutive months." I said, "This affliction that has come to me is only because of fasting." He then said, "Give one sa’ of dates to sixty poor people." I said, “I swear by the One who sent you as a Messenger, we have no sustenance.” The Messenger of Allah (peace be upon him) said, “Go to the collector of charity for the tribe of Banu Zureiq and ask him to give it to you, feed sixty poor people with one sa’ of dates from it, and you and your family eat the rest." I returned to my people and said to them, "I have seen much hardship and bad views from among you, but I have seen ease and good views from the Messenger of Allah (peace be upon him), and he has commanded me to give charity to you or for me.” [188]

2214 – The Messenger of Allah (peace be upon him) said: “Stay away from your family until you atone for your *zihar*.” [189]

2215 – He (a man) said, "O Messenger of Allah! All that I gave as dowry is with me." The Messenger of Allah (peace be upon him) said to Sabit ibn Kays, “Take back what you gave as dowry.” So Sabit took back what he had given as dowry from his wife Habiba, and Habiba returned to her father’s house to observe her waiting period. 2216 – Sabit ibn Kays divorced his wife for a price. The Messenger of Allah (peace be upon him) designated her waiting period as one menstrual cycle. Abu Dawud said that this hadith is mursal. [191]

2217 – The Messenger of Allah (peace be upon him) said to Abbas: “Do you not marvel at Berira’s excessive love for Mughis and Mughis’s hatred for her?” [192]

2218 – Mughis was a black slave who was the husband of Berira. The Messenger of Allah (peace be upon him) gave Berira the option to return to her husband or divorce, and ordered her to observe her waiting period. [193]

2220 – Qasim said: I asked the Messenger of Allah (peace be upon him) about the ruling regarding freeing two slaves at once. The Messenger of Allah (peace be upon him) ordered that the male slave should be freed before the female slave. 2221 – In the early days of Islam, a man embraced Islam. Afterwards, his wife embraced Islam. The man said, "O Messenger of Allah! My wife embraced Islam with me." The Messenger of Allah (peace be upon him) returned her to him. [196]

2222 – When a male embraces Islam, Islam is offered to the female; when a female embraces Islam, Islam is offered to the male. If they do not accept, then they are separated. [197]

Rasulullah (peace and blessings be upon him) said, “The Qur’an has descended concerning you and your wife. Go bring your wife.” Sahhl reported that I was also among the people with Rasulullah (peace and blessings be upon him). The husband and wife cursed each other. After the cursing ended, Uwaymir said, "If I were to harbor her in my home, I would be falsely accusing her." And Rasulullah (peace and blessings be upon him) divorced her with three revocable divorces without saying anything to her. Ibn al-Shahab said: This became the custom of couples who cursed each other. [202]

One Friday night we were in the mosque. A man from the Ansar entered the mosque and said, “If a man finds his wife with another man and says that she has done so, will you apply the hadd for slander? Or if he kills the man, will you take retaliation from her husband? If he remains silent, should he remain silent out of anger?” He vowed that he would certainly ask Rasulullah (peace and blessings be upon him) about this. The next day he came to Rasulullah (peace and blessings be upon him) and asked him this question. He said: “If a man finds his wife with a foreign man, and says so, will you apply the hadd for slander? Or if he kills that foreign man, will you take retaliation from the man? Or should he remain silent out of anger?”

Rasulullah (peace and blessings be upon him) was supplicating: “O Lord, open this matter, illuminate it.” Then the verse concerning cursing descended. "Those who accuse their wives of adultery, and have no witness but themselves…" A man was tested with this among the people. His wife and he came to Rasulullah (peace and blessings be upon him) and cursed each other. When the man spoke, he swore by Allah four times that he was telling the truth. In the fifth time, he said, “May the curse of Allah be upon me if I am one of the liars.” Abdullah narrates that the woman went to curse, and Rasulullah (peace and blessings be upon him) said to her, "(Did you) commit adultery?" The woman did not desist and cursed. When the cursing ended and they were turning away, Rasulullah (peace and blessings be upon him) said, “It is likely that this woman will give birth to a black-haired, curly-haired child.” Indeed, the woman gave birth to a child with black hair and curls. Ibn Abbas says: The woman hesitated, recoiled, and we thought she would turn back from her oath (and confess). She said, "I will never shame my people." She completed the oath of cursing, and Rasulullah (peace and blessings be upon him) said, “Watch over this woman. If her eyes are lined with kohl, her thighs are large and wide, and her toes are oily, then that child is from Sharik bin Samha.” The woman gave birth to a child with these characteristics.

Rasulullah (peace and blessings be upon him) said, "If there were not a provision in the Book of Allah concerning those who curse each other, I would have another situation with this woman." (That is, I would apply the hadd for adultery to her.) [204]

Rasulullah (peace and blessings be upon him) ordered couples who cursed each other to continue cursing, and commanded the man to put his hand over his mouth on the fifth occasion, saying: “This word, which invites the curse upon oneself, brings about punishment.” [205]

I heard Ibn Umar (may Allah be pleased with him) say: Rasulullah (peace and blessings be upon him) said to a husband and wife who were cursing each other, "One of you is lying. Your accounts are with Allah." (To the man), “You have no way to approach your wife.” The man said, "O Messenger of Allah, what will become of the property I gave her?" Rasulullah (peace and blessings be upon him) said, “If you are truthful in what you said about her, then the property is permissible for you as compensation. If you falsely accused her of adultery, then that property is far from you.” [206]

Someone said to Ibn Umar: A man accused his wife of adultery. Ibn Umar said: Rasulullah (peace and blessings be upon him) reconciled two brothers from the tribe of ‘Aclan’ (the couple) and said to them: “Allah knows that one of you is lying.” He repeated this three times, "Does anyone among you abandon their claim?" None abandoned their claims, so he separated them. [207]

Abu Dawud says: The wording which Malik narrated alone is the words, “He attached the child to his mother.” Yunus narrated from Zuhri, and Zuhri from Sahhl bin Sa’d in the hadith of cursing, that the woman denied her pregnancy. The child was being called by his name as if he belonged to her. [208]

Rasulullah (peace and blessings be upon him) said: “Are there any speckled camels among them?” The man said: "There is one speckled camel among them.” Rasulullah (peace and blessings be upon him) said, "What is your opinion about where he came from?" The man said, “It is as if a vein has emerged (prevailed) and it does not resemble anything.” Rasulullah (peace and blessings be upon him) said, “It is possible that this vein has drawn to this child. It has prevailed and become black." [209]

When the verse concerning cursing descended, I heard Rasulullah (peace and blessings be upon him) say: "Which woman brings a child who is not from her people into a tribe, so that she does not attain anything in the religion of Allah, nor will Allah place her in Paradise? Which man denies his son, even though he knows he is his own? Allah will veil His mercy from him.”

2285 – Narrated from Abu Salama bin Abdurrahman: Kays’s daughter Fatima also informed him. Abu Hafs bin Mughira divorced Fatima with three revocable divorces; the narrator transmitted this hadith concerning that matter. This narration contains these phrases as well: People from Khalid bin Walid and Banu Mahzum came to the Prophet ﷺ and said, "O Messenger of Allah, Abu Hafs bin Mughira has divorced his wife with three revocable divorces and left her a small maintenance.” The Prophet ﷺ said, “There is no maintenance for Fatima,” and transmitted the hadith. Malik’s hadith is more complete. [223]

But Mervan b. Al-Hakem hesitated to accept Fatima's statement regarding a divorced woman leaving her home with three revocable divorces. Urwa said: Aishah (may Allah be pleased with her) did not approve of Fatima binti Kays’s narration of this account. [224]

Umm Maktum was blind. She could remove her covering in her presence. She could not see. She remained there until the end of her waiting period. The Prophet ﷺ married her to Usama. A messenger informed Mervan through Kabiisa, and Mervan said: “We have heard this hadith from only one woman; we take the strong ruling upon which people are established.” When this reached Fatima, she said: "The Book of Allah is between you and me. Allah Almighty has said, 'Divorce your wives at their waiting periods.' Even after that, (it may be hoped that Allah will institute a command, which you cannot know)." Fatima said: “What command will Allah institute after three revocable divorces?” [225]

I was with Aswad in the Grand Mosque. Fatima binti Kays came to Omar bin al-Khattab. Omar (may Allah be pleased with him) said to her, "We cannot abandon the Book of our Lord and the Sunnah of the Messenger of Allah ﷺ based on the word of a woman. Does she preserve [her testimony], or does she not?" [226]

Aishah (may Allah be pleased with her) strongly rejected Fatima binti Kays’s hadith, saying: "Indeed, Fatima was in a desolate place. There was fear for her; so the Messenger of Allah ﷺ gave her permission to move to Abdullah ibn Umm Maktum's house.” [227]

It was said to Aishah (may Allah be pleased with her), “Did you not see Fatima’s statement?” Aishah (may Allah be pleased with her) said, "There is no good for Fatima in relating this hadith." [228]

2295 – Narrated from Qasim bin Muhammad and Suleiman bin Yasir: Yahya bin Said divorced his nephew definitively. Abdurrahman moved his daughter, who was observing her waiting period, from her husband’s house. Mervan was the governor of Medina. Aishah (may Allah be pleased with her) sent a message to Mervan saying, "Fear Allah. Send the woman back to her own home.” In Suleiman's hadith, Mervan said: “Abdurrahman overcame me.” In Qasim’s hadith, Mervan said: “Has news of Fatima binti Kays’s account not reached you? Aishah (may Allah be pleased with her) advises you not to mention this hadith from Fatima, for it will harm you." Then Mervan said: "If [her leaving the house] was due to a present evil to you, then the present evil between Yahya and his daughter is sufficient for you as an excuse.” [229]

My aunt was divorced with three revocable divorces. She went out to gather her own dates. A man met her and forbade her (from going out during her waiting period). My aunt came to the Prophet ﷺ and told him about it. The Prophet ﷺ said to my aunt, “Go and collect your dates; perhaps you will give charity or do good from them.” [230]

2298 – Narrated from Ibn Abbas (may Allah be pleased with him): "And those of your wives who die and leave behind them inheritances – they shall be provided for quietly during a year… until the verse was abrogated as it has been decreed by Allah to them in the verse of inheritance, as four-fifths and one-eighth; so too the waiting period of one year was limited to four months and ten days.” [231]

The Prophet ﷺ said, “Yes.” He said: "I went out to the enclosure or came to the mosque when I was called or ordered for her; I was summoned." The Prophet ﷺ said to me, “How did you relate?” I recounted to him the story I mentioned concerning the situation of my husband. The Prophet ﷺ said, “Act in accordance with the prescribed waiting period until it is completed.” She said: "I observed a waiting period of four months and ten days in my husband’s house." She said: "Omar bin al-Khattab, during his caliphate, sent me a message and asked me about it; I informed him about what the Prophet ﷺ had ordered me to do."

Atâ reported: "The Messenger of Allah ﷺ said, 'A woman who does not mourn her husband for more than three days is not one of us. She mourns him for four months and ten days.'" It is related that she may use white garments from Asb; she should not apply kohl, nor perfume herself. Yaqub added: "She may only use washed garments." Yaqub also added the words, 'she does not apply henna.'

The Messenger of Allah ﷺ said, “A woman whose husband has died cannot wear dyed clothes, red clay, or adornments. She cannot apply kohl, nor henna, and she should not be adorned.”

Umme Hakim, daughter of Asid, narrated from her mother that when her husband died, she had an ailment in her eyes and was treated with a stone called ismid. According to Ahmed bin Salih, the correct wording is 'she was treated with ismid kohl.' She then sent her slave girl to Umme Selama and asked if she could use it. Umme Selama said: "If you apply it because of an ailment, it will worsen it; if you must, apply it at night and wash it off in the morning." Then she continued, saying: “When Abu Selama died, the Messenger of Allah ﷺ came to me, and I had applied a medicine called ‘sabr’ to my eye. The Messenger of Allah ﷺ said, 'What is this?' I said, 'It is only patience; it has no scent.' The Messenger of Allah ﷺ said, 'It rejuvenates the face; apply it only at night and wash it off in the day. Do not use kohl, for it is a dye.’ Umme Selama asked, ‘With what should I comb?’ The Messenger of Allah ﷺ said, ‘With sidr that you place over your entire head.’”

Subey’a said: When she told her this, she came to the Messenger of Allah ﷺ in the evening and asked him whether she should marry or not. He gave her a legal opinion that she would be released from her iddah when she gave birth to her child, and ordered her to marry if a suitor appeared. Ibn al-Shihab said: "I see no objection to a pregnant woman marrying as soon as she gives birth to her child, even if she is in a state of post-natal bleeding; however, he should not approach her until she is purified."

"May whoever wishes curse (me) for proving that I am right." The short Surah Nisa (Surah Talaq) came down after (the verse in) Surah Bakara concerning four months and ten days.

Ibn Musanna said: "The Messenger of Allah ﷺ forbade us from mixing up the sunnahs. The iddah of a woman whose husband has died is four months and ten days." That is, the woman referred to is an umm waalid (a widow with children).

It was asked the Messenger of Allah ﷺ about a man who divorced his wife (with three divorces) and the woman married another man, and then, without touching her, he divorced her. Is she lawful to her first husband? Aishah said: "The Messenger of Allah ﷺ said, 'A woman is not lawful to the first man until she tastes the back of the second man’s neck.'"

He said, “It is unlawful for you to have intercourse with your neighbor's wife.” Abdullah bin Mas’ud said: "Allah revealed this verse to confirm the words of the Messenger ﷺ: ‘Those who do not worship any other than Allah, they do not kill a person (whose life Allah has forbidden) unjustly, and they do not commit adultery. Whoever does one of these things, he will be punished.’” (Surah Al-Hajj, verse 68).
