CHAPTER 22 – A WOMAN BEING MARRIED TO TWO MEN BY TWO GUARDIANS


Samura (may Allah be pleased with him) narrated:
The Messenger of Allah (peace and blessings upon him) said: "If two guardians (unaware of each other) marry a woman, then the marriage belongs to the first one who performed it. And if any person sells property separately to two people, then the property belongs to the first purchaser." [108]
EXPLANATION
The view of all scholars on this matter is unanimous. However, Imam Malik says that they cannot be separated if the second man consummates the marriage.
If the marriages are performed in sequence, the first marriage is valid and the second is annulled. If they marry at the same time, then both marriages are annulled.
