JIHAD SECTION · 137 – The Lawful Status of Eating in Enemy Territory


According to the narration of Ibn Umar (may Allah be pleased with him):
During the blessed time of the Messenger of Allah (peace and blessings be upon him), an army acquired provisions and honey as spoils of war, and a fifth was not taken from them as his share (for the Messenger of Allah, peace and blessings be upon him).
COMMENTARY:
If food is found in enemy territory and it is scarce, the finder may consume it. A fifth, which is the state’s share, is not taken from it.



Abdullah ibn Mughaffal (may Allah be pleased with him) narrated:
That on the day of the conquest of Khaybar, a storehouse full of oil was thrown open. I came to it and carried it upon my shoulder. Then I said, “I will not give anything from this to anyone today.” I turned around and saw that the Messenger of Allah (peace and blessings be upon him) was smiling at me.
