Arafat’ta vakfeye yetişemeyenin durumu

It is narrated from Abdurrahman bin Ya’mer ed-Deylî (may Allah be pleased with him) that he said:

The Messenger of Allah ﷺ was present in Arafat. I approached him, and a group of people from the tribe of Najit or a company of them arrived. They ordered a man to call out to the Messenger of Allah ﷺ, asking, "How is Hajj performed?" The Messenger of Allah ﷺ then commanded a man, who announced loudly, “Hajj is on the Day of Arafat.” Whoever arrives in Arafat before Fajr prayer on the night of Muzdalifah (and performs standing – *waqf*) has completed his Hajj. The days of Mina are three. Whoever hastens and leaves [Mekkah] with two days, there is no sin upon him. And if he delays until the third day, there is no transgression upon him. Then a man took hold of his garment and kept repeating these things loudly.

Abu Dawud said: Mihran also narrated it from Sufyan, and he repeated the word "Hajj" twice. Yahya bin Said al-Qattan also narrated from Sufyan, and he mentioned the word "Hajj" once. [24]

**EXPLANATION:**

This honorable hadith is a clear indication that one of the pillars of Hajj is standing (*waqf*) in Arafat from noon on the Day of Arafat until sunrise on the day of Eid; and that those who fail to stand even for a moment during this time, their Hajj is not valid. The obligatory time for *waqf* in Arafat is from noon until sunset. If a pilgrim fails to reach Arafat during the day, if he reaches it on the night of Eid, he has still fulfilled one of the pillars of Hajj. It is obligatory to remain until sunset on the Day of Arafat. With unanimous agreement, sacrifice is required if one descends to Muzdalifah before sunset. If one returns to Arafat after sunset, according to Imam Azam, the sacrifice must again be slaughtered. According to Malik and Shafi’i, there is no penalty for returning. The first day in Mina is counted as the Day of Sacrifice. The second, third, and fourth days are the Days of Tashriq.

There is no transgression in descending to Mekkah on the third day, which is considered the second day of the Days of Tashriq, nor is there any transgression in descending on the fourth day, which is considered the third day of the Days of Tashriq; rather, it is more virtuous, because throwing the stones on the fourth day is a *sunnah*.

1950 – Urve bin Mudarris at-Ta'i, may Allah be pleased with him, related:

He said: “I came to the place of standing (at Muzdalifah), and I said to the Messenger of Allah, peace and blessings be upon him, ‘O Messenger of Allah, I have come from Mount Tayy, my conveyance is weary. I have exerted myself. By Allah, I have not left any sand dune that I did not stand on; has my pilgrimage been fulfilled?’ ”

The Messenger of Allah, peace and blessings be upon him, said: “Whoever reaches us (for the morning prayer of Eid) and before that spends some part of the night or day at Arafat and stands [in i’tikaf], his pilgrimage is complete, and he may cut his hair and shave.” [25]

EXPLANATION

*Eklektü:* I was weary, I exerted myself.

*Habl:* Hill, sand dune.

*Tefes:* To shave the mustaches, to clip the nails, to remove the ihram; in another manuscript (of Mount Tayy).

The two mountains belonging to the tribe of Tay are called “Mount Aja and Mount Selma.”

Standing at Muzdalifah is obligatory. According to Imam al-A’zam, the time for standing there is between twilight and sunrise. One who descends to Mina before twilight is obligated to sacrifice an animal because he has neglected his obligation. Those engaged in work, the sick, and those carrying goods may descend after midnight.
