SECTION OF NIKAH · 5 – THE QUR'ANIC VERSE REGARDING THE MARRIAGE OF THOSE WHO COMMIT ZINA
2051 – It is narrated from ʿAmr ibn Shuʿayb, from his father, from his grandfather: Mersed ibn Abū Mersed al-Ghanawī used to bring captives to Mecca. There was a prostitute in Mecca named Anak. She was his companion. Mersed says: I came to the Messenger of God (peace and blessings be upon him) and asked, “O Messenger of God, may I marry Anak?” The Messenger of God (peace and blessings be upon him) remained silent and did not answer me. Immediately, the following verse was revealed: “The adulterer does not marry except an adulteress or a polytheist woman.” The Messenger of God (peace and blessings be upon him) called me, recited it to me, and said, “Do not marry Anak.” [83]
EXPLANATION
This verse is the third verse of Sūrat al-Nūr. It was revealed concerning the prostitute from the disbelievers of Mecca named Anak. This ruling is specific to her. The marriage of a Muslim woman who is merely suspected of having committed zina (unlawful sexual intercourse) in the past cannot be annulled. (Sharḥ al-Khaṭṭābī)
2052 – It is narrated from Abū Hurayra (may Allah be pleased with him): The Messenger of God (peace and blessings be upon him) said, “A man who has been flogged for zina (unlawful sexual intercourse) may only marry someone like himself.” Abū Maʿmar said: Ḥabīb al-Muʿallim informed me, who narrated from ʿAmr ibn Shuʿayb.
