WILLS CHAPTER · 16 – THE WILL OF A WARRIOR WHOSE GUARDIAN IS A MUSLIM
Amr bin Shu'aib has narrated from his grandfather:
‘As ibn Wail bequeathed the manumission of one hundred slaves in his will. His son, Hisham, freed fifty slaves, and his other son, Amr, wished to free the remaining fifty slaves. He said, "I will ask the Messenger of Allah (ﷺ) about this." So he came to the Messenger of Allah (ﷺ). He said, “O Messenger of Allah! My father bequeathed the manumission of one hundred slaves. (My brother) Hisham freed fifty in his name. Fifty slaves remain. Should I free them in his name?”
The Messenger of Allah (ﷺ) said, "If your father had been a Muslim, you would have freed slaves on his behalf or given charity on his behalf or performed Hajj on his behalf; it would benefit him."
EXPLANATION:
‘As ibn Wail was not a Muslim. Because the actions of his Muslim children freeing slaves on his behalf would not benefit him, he said, "If your father had been a Muslim, your generosity would benefit him. Since he is not a Muslim, your generosity will not benefit him.”
