The Graveyard Section · 76 – Building on a Grave


Jabir (may Allah be pleased with him) said: I heard the Messenger of Allah (peace and blessings upon him) prohibit sitting on graves, the plastering of graves, and building over graves.




It is related through another route from Jabir, may Allah be pleased with him. Abu Dawud said:
Osman forbade taking more earth than that which was already upon the grave. In the narration of Suleyman ibn Musa, he added the phrase, “and from writing on it.” The hadith of Musaddad does not mention the phrase, "from placing additional earth upon it." [124]
Abu Dawud said: Perhaps this phrase of Musaddad escaped my notice.


Abu Hurayrah, may Allah be pleased with him, narrated that the Messenger of Allah, peace and blessings be upon him, said: “May Allah take the souls of the Jews, for they have made the tombs of their prophets into masjids.” [125]
COMMENTARY
Building over graves is disliked. Especially in public cemeteries, building over a grave and thus narrowing the cemetery is not appropriate.
