SHOPPING SECTION · 33 – CULTIVATING LAND WITHOUT THE OWNER'S PERMISSION


On the authority of Rafi bin Hadic (may Allah be pleased with him), he narrated:
The Messenger of Allah (ﷺ) said: “If someone cultivates the land of a people without their permission, then nothing is given to him from that cultivation; but he has an expense for it.”
COMMENTARY
If someone cultivates land without permission, he cannot benefit from the produce. However, his expenses are paid to him. Ahmad bin Hanbal said: If the produce is still in the field, it belongs to the owner of the field. But if it has been harvested, the rent is given to the owner of the land.
