SECTION ON ZAKAT · 29 – GIVING CHARITY TO THE BANU HASHEM




Abū Rāfiʿ, may Allah be pleased with him, narrated:
The Messenger of Allah, peace and blessings be upon him, appointed a person from the Banī Maḥẓūn to collect zakat. That person said to Abū Rāfiʿ, "Accompany me, and you will receive something from the zakat." Abū Rāfiʿ said, “I will go ask the Messenger of Allah about it.” He came to the Messenger of Allah, peace and blessings be upon him, and asked, “If I were to go with so-and-so to collect zakat, would I receive something from the zakat when I bring it [to you]?” The Messenger of Allah, peace and blessings be upon him, said, "A freed slave is considered one of the family members of his former people. Zakat and food are not permissible for us from them.” [491]
EXPLANATION:
Zakat is forbidden to the Messenger of Allah; and according to most scholars, it is also forbidden to Banī Hāshim.


Anas (may Allah be pleased with him) related: The Messenger of Allah (peace and blessings upon him) would sometimes come across dates that had fallen on the road, their owner unknown, but he would refrain from taking them for fear that they might be part of zakat property.
EXPLANATION
Imam Shafi’i states that zakat should not be taken from the descendants of Abd al-Muttalib because zakat is a tax upon people's wealth.
At-Tamratu al-'Airah: This refers to dates that have fallen on the ground, and their owner is unknown.


Anas (may Allah be pleased with him) narrated: The Messenger of Allah (peace and blessings upon him) found a date. He said, "If I were not afraid that it was charity, I would eat it."


It is narrated from Ibn Abbas, may Allah be pleased with him, that his father (Abbas) sent him to the Messenger of Allah ﷺ regarding a zakat camel which the Messenger of Allah ﷺ had given to him.

It is related from Ibn Abbas, may Allah be pleased with him:
The same hadith was narrated, and here is an addition: My father used to exchange that camel for the Prophet, peace and blessings be upon him.
