FUNERALS SECTION · 52 – PERFORMING THE FUNERAL PRAYER FOR A PERSON EXECUTED BY LEGAL PUNISHMENT
3186 – It is narrated from Abū Barzah al-Aslamī (may Allah be pleased with him): The Messenger of God (peace and blessings be upon him) did not perform the funeral prayer over Māʿiz ibn Mālik (who confessed to adultery and was stoned), but he did not prohibit performing the funeral prayer for him. EXPLANATION
According to the Ḥanafī school, the funeral prayer is performed for a person who has been stoned. This is because the Pride of the Universe, our Master, commanded, “Seek forgiveness for Māʿiz ibn Mālik.” The noble Companions (ṣaḥāba) also said, “May Allah forgive Māʿiz ibn Mālik.” According to Imām al-Shāfiʿī, the funeral prayer is performed for all those who face the qibla (i.e., all Muslims). No one may be buried without the funeral prayer being performed for them due to their crime. According to Imām Mālik, the imam does not perform the funeral prayer for the person he has ordered to be stoned, but he does not prevent the people from performing the prayer for him. Aḥmad ibn Ḥanbal states that the imam does not perform the funeral prayer for the person he has executed or for the highway robber.
