Volume 3 – 75 – Spending Mina Nights in Mecca
It is narrated from Harith or the father of Harith:
The narrator of this report is Yahya.
He heard Abdurrahman bin Farruh say to Ibn Umar, “We sell the goods of people (during the nights in Mina), and one of us comes to Mecca, lying at the head of the merchandise. Is there any harm in that?”
Ibn Umar replied, "But the Messenger of Allah, peace be upon him, spent the nights in Mina and did not often refrain from it."
EXPLANATION:
The scholars differed regarding sleeping in Mecca during the nights in Mina.
Ibn Abbas, may Allah be pleased with him, said that there is no objection to those who have merchandise sleeping in Mecca.
Al-Imam al-A’zam (Abu Hanifa) and his companions said: No penalty is required for one who sleeps in Mina at night after having thrown the stones at their appointed time, but he has opposed the Sunnah and committed an objectionable act by doing so.
Ash-Shafi'i said: There is no sleeping in Mecca during the nights in Mina except for those distributing Zamzam to pilgrims. No concession is given for this; one who sleeps for one night must give a dirham, one who sleeps for two nights must give two dirhams, and one who sleeps for three nights must sacrifice an animal as atonement.
Al-Imam Malik said: Atonement in the form of sacrifice is required even for sleeping for one night.
Sikaya: Refers to the task of preparing Zamzam for pilgrims. This duty was upon Abbas (may Allah be pleased with him). The Messenger of Allah, peace be upon him, gave him permission to descend to Mecca during the nights in Mina.
Zalle: Refers to working at night after doing work during the day. It can also be used to mean its opposite.
Zalle: Also means epilepsy. (From Kamus)
‘Abdullah ibn ‘Umar, may Allah be pleased with him, narrated:
Abbas ibn ‘Abd al-Muttalib, may Allah be pleased with him, requested permission from the Messenger of Allah, peace and blessings be upon him, to stay overnight in Mecca for the task of distributing Zamzam water during the nights of Mina. The Messenger of Allah, peace and blessings be upon him, permitted him.
