WILLS CHAPTER · 9 – WHEN DOES ORPHANHOOD END
Ali ibn Abi Talib, may Allah be pleased with him, narrated: “I memorized from the Messenger of Allah, peace and blessings be upon him, ‘There is no more orphanhood after the sign of puberty, which is nocturnal emission. Nor is there [any obligation of] silence night and day.’”
COMMENTARY: The ruling pertaining to being an orphan ends with reaching puberty. An orphaned child, after attaining puberty, gains the right to buy and sell, dispose of his property, and marry himself. In the case of a girl’s marriage, permission is sought from her. There is no fast of silence in Islam. Beneficial speech should be spoken. During the pre-Islamic period, there was a fast of silence. They would not speak for an entire day, considering it an act of worship.
