Divorce Section · 26 – When a Parent Converts to Islam, With Which Parent Will the Child Stay?
It is narrated from Rafi bin Sinan (may Allah be pleased with him) that he embraced Islam, but his wife refused to do so. The woman came to the Messenger of Allah (peace and blessings upon him). She said, “My daughter has been weaned, or she has reached an age where she may be considered such (and is mine).”
Rafi said, “The girl is mine.” The Messenger of Allah (peace and blessings upon him) then commanded Rafi, "You sit over here," and the woman, "You sit over there." He placed the child between them. He (the Prophet) then said, “Both of you call her.” They called her, and the child leaned towards her mother. The Messenger of Allah (peace and blessings upon him) said, “O Allah, guide this child.” Then the child leaned towards her father. He took her from her father. [201]
