LEASE SECTION · 74 – DISPUTES BETWEEN SELLER AND BUYER WHEN THE SOLD GOODS ARE PRESENT
Muḥammad ibn ‘Ash’as, related through his father, concerning his grandfather, that:
‘Ash’as purchased several slaves as spoils of war for twenty thousand dirhams from Abdullah ibn Mas’ud. Then Abdullah sent someone to ‘Ash’as to demand the price of the slaves. ‘Ash’as said, “I bought them for ten thousand dirhams.” Upon this, Abdullah ibn Mas'ud said to ‘Ash’as, "Appoint an arbitrator between me and you." ‘Ash’as replied, "You are the arbitrator between me and you." Then Abdullah ibn Mas'ud said, "I heard the Messenger of Allah, peace and blessings be upon him, say: 'When a seller and a buyer disagree, and there is no proof among them, then the judgment is according to what the owner of the goods says, or they abandon the transaction.'"
Kasim's father, Abdurrahman bin Kays, related that Ibn Mas’ud, may Allah be pleased with him, mentioned the meaning of the preceding hadith, stating that he sold slaves to ‘Asas bin Kays. However, there are more and fewer words between the preceding hadith and this narration.
