Section 6 – A freed slave cannot be compelled to work to pay for the remaining portion of their value.



Abdullah ibn Umar (may Allah be pleased with him) narrated:
The Messenger of Allah (peace and blessings upon him) said: "Whoever emancipates his share of a slave, then a just value is assigned to the slave. The shares of the other partners are paid off. The slave is freed by him. If he cannot afford to free the other shares, only the share that was emancipated becomes free."


From Ibn Umar, may Allah be pleased with him: The meaning of the preceding hadith was narrated. (One of its narrators, Ayyub, said:) Nafi related this hadith, sometimes saying the phrase "the slave is freed," and sometimes omitting it.



From Ibn 'Umar, relating a hadith preceding this one. Ya'qub related, saying: "I do not know whether the statement, 'Only the portion that was freed is freed from the slave,' is reported from the Messenger of Allah, peace and blessings be upon him, or if it is something narrated by Nafi'." [526]



According to a narration from Ibn ‘Umar, may Allah be pleased with him, the Messenger of Allah, peace and blessings be upon him, said: “Whoever emancipates a share of his slave, then he must emancipate the entire slave. If he has the means to pay its price, let him pay it. Otherwise, he has emancipated what he possessed.”


It was narrated from Ibn Umar that the meaning of the preceding hadith was related.


It was related that the meaning of a hadith narrated by Malik from the Messenger of Allah, peace and blessings be upon him, was recounted. The narrator omitted the phrase, "He only emancipates what he possesses." Ibn Umar continues this hadith in accordance with the meaning of Malik’s hadith, concluding with the statement: “The slave is emancipated on his behalf.”


According to a narration from Ibn Umar, may Allah be pleased with him, the Messenger of Allah, peace and blessings be upon him, said: “Whoever emancipates his share in a slave, if he has sufficient wealth to cover the price of the remainder of the slave, then the remainder of the slave is also emancipated from his property.”



It is narrated on the authority of Salim’s father, through a chain of narrators reaching the Messenger of Allah (peace and blessings be upon him):
“When a slave is jointly owned by two persons, and one of them emancipates his share, and the wealthy person assigns a value to the slave – neither deficient nor exceeding what is proper – then that sum is paid, and the slave is set free.”


It is narrated from the father of al-Talib:
A man freed his share of a slave. The Messenger of Allah, peace and blessings be upon him, did not obligate him to free the other shares.
