LEASE SECTION · 86 – A WOMAN MAKING GIFTS WITHOUT HER HUSBAND'S PERMISSION
When a woman possesses property and her husband has control over her marital chastity, it is not permissible for her to make gifts from her property without his permission.
It is narrated from Abdullah bin Amr (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: “A woman’s gift from her own property is not permissible without the permission of her husband.” [304]
EXPLANATION
After a man marries a woman, consulting with him regarding expenditures from her own property leads to a peaceful life together. A woman may make expenditures from her own property without consulting her husband, but consultation is suitable for a harmonious living. However, a woman’s unauthorized expenditure from the man's property is not permissible. But a few pounds and some food given to the poor are considered as customarily permitted by the man.
