LEASE SECTION · 42 – RECEIVING A FEE IN EXCHANGE FOR THE FERTILIZATION OF A MALE ANIMAL


Narrated by Ibn ‘Umar:
The Messenger of Allah ﷺ forbade taking payment for the service of a male animal.
**Explanation:**
It is forbidden to take payment for using a male animal for breeding purposes.
The majority of scholars have ruled that the money taken for this is unlawful, stating that it is not certain whether offspring will result from it. Imam Malik said that if it is leased for a period of time, there is no objection to that. In many places, especially with thoroughbred horses, they are not allowed to be bred without payment. Therefore, the breeding is done first, then fodder is given to the horse and it is sent away; there is no objection to this. However, a direct fee stipulated as "you will give this much money" is not permissible.
