RENT SECTION · 43 – JEWELER’S FEE
According to the narration of Abu Majidah, may Allah be pleased with him:
I cut off a slave’s ear or part of his ear.
Hazrat Abu Bakr had returned from Hajj. We gathered around Hazrat Abu Bakr, and he conveyed our matter to Umar ibn al-Khattab. Umar ibn al-Khattab ruled that this slave was deserving of retaliation (qisas) and ordered me, "Call a blood avenger." When he called the blood avenger, he said, “I heard the Messenger of Allah, peace and blessings be upon him, say: ‘I gifted a slave to my aunt, hoping that he would be beneficial to her. But I forbade her from handing this slave over to the cupper, the goldsmith, or the butcher.’”
Abu Dawud said: Umar ibn al-Khattab narrated from Abd al-'Ala, who is Ibn Ishaq’s son, and he is a man from Banu Sahm.
EXPLANATION:
1 – There was previous mention regarding the blood avenger.
2 – Regarding handing him over to the goldsmith, it is [due to] false promises being made in goldsmithing and interest becoming prevalent. For he sells one hundred grams of gold for one hundred grams of gold, then takes an additional sum as profit.
3 – Regarding not handing him over to the butcher, it is because clothing would not remain clean. (Ma’alim al-Sunan)
