IJĀRA SECTION · 87 – UMRA (GIFT WITH LIFE TENURE CONDITION)
3548 – It is narrated from Abū Hurayra (may Allah be pleased with him) that the Messenger of God (peace and blessings be upon him) said: “Umrā is permissible.” [305]
EXPLANATION
Umrā (gift with life tenure condition): This means that a person gives his property to another by tying it to his own or the recipient’s lifetime. For example, if a person says, “As long as I live, or as long as you live, this house is yours; after your death, it is mine,” this transaction is considered umrā.
3549 – It is narrated from Samura (may Allah be pleased with him), who also reported from the Messenger of God (peace and blessings be upon him), a narration similar to the previous hadith.
3550 – It is narrated from Jābir (may Allah be pleased with him) that the Messenger of God (peace and blessings be upon him) said: “The property that is given as a gift on the condition of use for as long as one lives belongs to whomever it was given.”
3551 – It is narrated from Jābir (may Allah be pleased with him) that the Messenger of God (peace and blessings be upon him) said: “If a property is given to someone as a gift for a lifetime, it belongs to the one to whom it was given and to his children. Those of his children who inherit from him will also inherit that property.”
3552 – Through the narration of Jābir (may Allah be pleased with him), it is reported from the Messenger of God (peace and blessings be upon him): They narrated a hadith with the same meaning as the previous one.
