LEASE SECTION · 75 – PRE-EMPTION RIGHT



Jabir (may Allah be pleased with him) narrated: The Messenger of Allah (peace and blessings upon him) said: “Shufa is applicable in every shared house and garden. It is not permissible for one to sell it without the permission of his partner. If he sells without consultation, then the partner has a prior right to purchase it until the news reaches him.” [285]



Jabir ibn Abdullah (may Allah be pleased with him) narrated:
The Messenger of Allah (peace and blessings upon him) restricted the right of pre-emption to undivided property. He said, “When property is divided and boundaries are demarcated and ways are opened, the right of pre-emption ceases.”


Abu Hurayra (may Allah be pleased with him) narrated that the Messenger of Allah (peace and blessings upon him) said: “Once land is apportioned and boundaries are defined, there is no right of pre-emption.”

Abū Rāfiʿ, may Allah be pleased with him, narrated that the Messenger of Allah, peace and blessings be upon him, said: “The neighbor has more right to the property being sold nearby than anyone else.”


Semürah (may Allah be pleased with him) narrated: The Messenger of Allah (peace and blessings upon him) said: “The neighbor is more deserving of the house he neighbors and the land.”


Jabir ibn Abdullah (may Allah be pleased with him) narrated:
The Messenger of Allah (peace and blessings upon him) said: “The neighbor has more right to the need of his neighbor than others. And if the roads join, then he is expected to come even from outside the homeland.”
