CHAPTER ON LEASES · 92 – THE STATUS OF ANIMALS THAT DAMAGE PEOPLE'S CROPS



Haram ibn Muhayyisa, may Allah be pleased with him, narrated from his father, saying:
The camel of Bara’ ibn Azib entered the garden of a person and spoiled it. Consequently, the Messenger of Allah, peace and blessings be upon him, decreed that during the day, owners should protect their property (the garden), and at night, those who owned animals should protect their animals.




Berâ bin Âzib (may Allah be pleased with him) narrated:
"A man possessed a camel that was accustomed to entering the gardens of others.
(One day) it entered a garden and caused damage therein. This matter was brought to the Prophet (peace and blessings be upon him). The Messenger of Allah (peace and blessings be upon him) decreed that during the daytime, the owners of gardens should protect their gardens, and at night, the owners of animals should protect their animals, and that the damage done by the animals at night belongs to their owners."

Some people from the tribe of Sufyan taught me to read and write the Qur’an.
One of them gifted me a bow. This is not personal property.
I said, “I will use this for archery against the enemy in Allah's path, and I will go to the Messenger of Allah (peace be upon him) and ask about its ruling.” Then I came before the Messenger of Allah (peace be upon him), and said, "O Messenger of Allah, one of those whom I taught writing and the Qur’an gifted me a bow. This is not personal property; I will use it for archery in Allah's path."
The Messenger of Allah (peace be upon him) said, “If you wish to have a ring of fire placed around your neck, accept it.” [229]
A man from the tribe said: "I practice magic, but we asked you to host us, and you avoided hosting us. I will not enchant your chief unless you fix a reward for me." They fixed a flock of sheep as his reward. Then he came to the chief and recited Ummul Kitab (Al-Fatiha) over him and blew upon him. The chief was released from the effect of poison, just as if he had been untied from a rope, and they gave him the flock they had agreed to give them.
The companions said, "Distribute the sheep." The man who practiced magic said, “Let us go to the Messenger of Allah (peace be upon him) and seek his opinion.” They came before the Messenger of Allah (peace be upon him) in the morning and told him about it. The Messenger of Allah (peace be upon him) said, "Where did you learn this magic? You have done well. Set aside a share for me from the flock." [230]
The Messenger of Allah (peace be upon him) said: “The fee of the blood-letter is foul. What is taken in exchange for the sale of a dog is foul. The reward that a prostitute takes for adultery is foul (haram).” [231]
He asked permission from the Messenger of Allah (peace be upon him) to take payment for bleeding. The Messenger of Allah (peace be upon him) forbade Muhayyisa from taking money for bloodletting. Muhayyisa continued to ask whether this money was lawful and requested permission to consume it. The Messenger of Allah (peace be upon him) then ordered, “Use it to buy feed for your camel or give it to your slave.” [232]
The Messenger of Allah (peace be upon him) had bloodletting done and paid the blood-letter his fee. If this money were foul, he would not have paid the fee for the bloodletting. [233]
The Messenger of Allah (peace be upon him) had Abu Tayba bleed him. The Messenger of Allah (peace be upon him) ordered that a sa’ of dates be given in return for this service and ordered that Abu Tayba's zakat be eased. [234]
The Messenger of Allah (peace be upon him) forbade women from earning a livelihood. [235]
The Messenger of Allah (peace be upon him) forbade taking payment for the male animal’s insemination. [236]
“Whoever sells a slave who has property, the slave's property belongs to the seller, unless the buyer stipulates that he buys it along with the slave.” It was said, “Whoever sells a grafted date palm tree, its fruit belongs to the seller, unless the buyer stipulates that he buys it along with the purchase." [237]
3434 A – Ibn-i Umar narrated from the Messenger of Allah (peace be upon him) the same story as mentioned above. [238]
The Messenger of Allah (peace be upon him) said: “Let none of you sell on another’s sale, and do not meet the caravan outside the town.” [239]
Sufyan said: The meaning of "let none of you sell on another's sale" is that he says, 'I have something better than this for ten dirhams.' [240]
“Do not inflate the price of goods by mutual bidding to tempt one who will not buy.” [241]
He replied, “Let him not act as a broker for it." [242]
– It was said, "Let him not trade on behalf of a city-dweller." But this is a word that means he cannot sell or buy anything in his name. [243]
“Let the city-dweller not sell the goods of one who lives in the desert (village), let people be left to their own affairs, for Allah provides for some through others.” [244]
"Do not meet the caravan (outside the town) for trading, and let none of you sell on another’s sale. Do not take money for the milk of camels and sheep."
(in order to deceive) do not delay in the udder. When the milk of these animals is retained in the udder, whoever buys it after milking has a choice between two opinions. If he is pleased, he keeps the animal; if he is not pleased, he returns it to the seller. He returns one sa’ of dates (because of having milked it)." [245]
“If someone buys a sheep whose milk has been retained in the udder (for two or three days), that person has three days of *muhayyar* (option). He may return the sheep with a sa’ of food that is not made from wheat." [246]
"Whoever buys a sheep which has had its milk retained (for two or three days) and milks it, if he is pleased with the animal (and its milk), he keeps it. If he is not pleased, he gives one sa’ of dates for each milking.” [247]

The Messenger of Allah, peace and blessings be upon him, forbade Muslims from breaking their coins (currency in circulation) unless there was necessity. [249]
“Allah is the One who determines prices, brings abundance or scarcity, and provides sustenance.” He responded, “By God, I hope that none of you will meet his Lord except without any debt owed to Me, nor have been wronged by Me regarding blood or property." [250]
He said, "The deceiver is not one of us." [251]
It was narrated from the Messenger of Allah, peace and blessings be upon him, in a report with the same meaning as the preceding hadith. Ibn Umar reported: Or if the seller and buyer say to each other, ‘You have *muhayyar*’ (option)." [252]
“The seller and buyer are not separated until they are satisfied with each other. Except when *muhayyar* occurs between them – that is, when one of them says, 'I am going to sign the contract or leave it.' It is not permissible for either of them to depart quickly from his companion out of fear that the other will cancel the agreement.” [253]
Hisham bin Hassan reported: The narrator, Jamil bin Murra, said that Abu Barza stated, ‘I have never seen you two separated.’” [254]
“Let those who engage in trade separate with satisfaction.” [255]
"The seller and buyer are not separated until they are satisfied with each other. If the seller tells the truth about the condition of the goods and discloses its defects, their transaction will be blessed. But if he conceals a defect in the goods and lies when describing them, then blessing has been removed from their transaction.” [256]
“Whoever gives *ikala* (a form of sale with repurchase) to a Muslim, Allah will cause his foot to slip (into error) and accept his repentance." [257]
"When selling dates on consignment, specify the measure, the weight, and the time limit.” [258]
– It was narrated by one who reported it as Abdullah bin Awfa. [259]
“If someone buys a commodity on consignment, he should not exchange it for another commodity." [260]
In the early days of Islam, the fruit of a man was destroyed by disaster. The man’s debt increased. The Messenger of Allah, peace and blessings be upon him, said, “Help him.” People helped him, but this assistance was not sufficient to pay off his debt. Then the Messenger of Allah, peace and blessings be upon him, said to the creditors, "You may only take what is in your hands." [261]
“If you sell dates to a brother (in faith) while they are still on the tree, and a disaster strikes them (so that you cannot deliver the dates), it is not permissible for you to take anything from your brother. How will you take something from his property unjustly?” [262]
"The excess water (from a well) should not be sold because it will eventually reach the one who needs it." [263]
Thirdly: He forbade anyone who attaches himself to an imam and fulfills the obligations of that attachment if the imam gives, but does not fulfill those obligations if the imam withholds. [264]
The Messenger of Allah, peace and blessings be upon him, forbade selling excess water. [265]
The Messenger of Allah, peace and blessings be upon him, forbade taking money for a cat (sold). [266]
3481 – It was narrated that Abu Mas’ud al-Riyadi reported: The Messenger of Allah, peace and blessings be upon him, forbade the price of a dog, the earnings of a prostitute from illicit intercourse, and what an astrologer takes for his predictions. [267]
The Messenger of Allah, peace and blessings be upon him, forbade taking the price of a dog. [268]
“May Allah destroy the Jews, for they used to forbid the fat of animals. They would melt it down and sell it, and eat its price.” [269]
– It was said: “This was when the verses about *riba* (interest) were revealed in Surat al-Baqarah." [271]
We used to buy food in the Messenger of Allah’s time (during his life). The Messenger of Allah, peace and blessings be upon him, would send for us and order us to move it to another place before we sold it. That is, he bought it on a carry basis. [272]
The Messenger of Allah, peace and blessings be upon him, forbade anyone from selling food that he had purchased by measure until he received it. [273]
Sulayman bin Harb reported: Until it is fully received. [274]
I have seen people being beaten because they used to buy food on a carry basis and sell it without moving it to their own property. [275]
The person who was deceived in trade was Habban bin Munqiz. He lived one hundred thirty years.
"Eğer satışı terk edemiyeceksen (satış yaparken) malı al, karşılığını ver, aldatmak yok de” buyurdu. [277]
Bir kimse köleyi satın alır veya hayvan kiralar ve sonra, ben sana bir dinar vereceğim, eğer aldığım malı ve kirayı terk edersem sana verdiğim para senin olacak der. [278]
– Ya Rasûlallah sallallahu aleyhi ve sellem, bana bir müşteri gelir, benden dükkânımda olmayan bir malı ister. Ben de o kimseye, o malı çarşıdan alıversem olmaz mı? Peygamber Efendimiz: “Hayır sende bulunmayan malı satma” buyurdu. [279]
“Kölenin garantisi üç gündür, (üç günden sonraki kusurlardan satıcı sorumlu olmaz).” [280]
“Mefaat, sorumluluk (risk) karşılğındadır.” [281]
Ey Allah’ın Rasûlü, bu zât benim kölemi çalıştırdı (ondan istifade etti) dedi. Rasûlullah sallallahu aleyhi ve sellem: “Menfaat mesuliyet karşılığıdır” [282] buyurdu.
“Satıcı ile alıcı anlaşmazlığa düşerler ve aralarında delil de bulunmazsa, o zaman hüküm mal sahibinin dediğinedir veya alış verişi fesh eder bırakırlar” buyurduğunu işitti dedi. [283]
3512 – Kasım’ın babası Abdurrahman bin Kays’den rivâyet ettiğine göre İbn-i Mes’ûd radıyallahu anh Eş’as bin Kays’a köleler sattı diyerek bir önce geçen hadisin manasını zikretti. Ama geçen hadisle bu rivâyet arasında birbirinden ziyade ve eksik kelimeler vardır. [284]
“Ortak olan her ev ve bahçede şüfa hakkı cârîdir. Ortağı izin vermedikce onu satması uygun değildir. Eğer danışmadan satarsa, ona haber verene kadar ortağı, o malı satın almaya daha haklıdır” buyurdu. [285]
“Arazi taksim edilip, hudutları tayin edildikten sonra şüfa hakkı yoktur.” [286]
“Komşu kendisine yakın olan malı satın almaya herkesten daha çok hak sahibidir.” [287]
“Evin komşusu, komşu olduğu eve ve araziye başkasından daha müstehaktır.” [288]
“Komşu, komşusunun şüfasına başkasından daha müstehaktır. Yolları bir olduğu takdirde memleket haricinde ise gelmesi beklenir.” [289]
“Bir kimse iflas eder, alacaklılardan bir zât da kendi eşyasını iflas edenin yanında bulursa, malın sahibi bu mala başka alacaklılardan daha müstehaktır.” [290]
“Sütlü dişi hayvan rehin olduğu zaman bakımı, yemi, suyu karşılığında (rehin alan tarafından) sağılabilir. Binek hayvanı rehin olduğunda yemi, suyu ve hizmeti karşılığında (rehin alan tarafından) binilebilir. Bu hayvanların yemi, suyu sağan ve binenlere aittir.” [291]
Rasûlullah sallallahu aleyhi ve sellem: “Kişinin yediğinin en hayırlısı kendi kazancından olanıdır. Kişinin çocuğu da onun kazancındandır” buyurdu. [292]
Ebû Dâvud dedi ki: Hammad bin Ebî Süleymân rivâyetinde “ihtiyaç duyduğunuz zaman” sözünü ilave etti ama bu münkerdir. [293]
Rasûlullah sallallahu aleyhi ve sellem, “Sen ve malın babanındır. Sizin çocuklarınız sizin en güzel kazançlarınızdandır. Öyle ise çocuklarınızın kazancından yiyiniz” buyurdu. [294]

Rasûlullah sallallahu aleyhi ve sellem, hediyeleri kabul eder ve karşılığında hediye verirdi. [298]
“Allah’a yemin ederim ki, bu günden sonra, Kureyşli muhacirlerden, Ensârdan Devslilerden ve Sakiflilerden başka hiç kimseden hediye kabul etmeyeceğim.” [299]
“Hîbesinden dönen kimse, kusmuğunu yiyen kimse gibidir.” [300]
“Bir kimsenin, bir ikramda bulunup veya hîbe edip sonra ondan dönmesi helal olmaz, ancak baba çocuğuna yaptığı hîbeden dönebilir. İkramda bulunanıp, sonra dönen kimsenin durumu, bir şeyi yiyen, doyduğu zaman kusana, sonra da kusmuğunu tekrar yiyen köpeğin durumu gibidir.” [301]
Babası ona bir köle vermişti. Rasûlullah sallallahu aleyhi ve sellem kendisine: “Bu köle kimdir” diye sordu. Numan; bu benim kölemdir. Onu bana babam verdi, dedi. Rasûlullah sallallahu aleyhi ve sellem, “Baban sana verdiği gibi bütün kardeşlerine de verdi mi” buyurdu. Numan: “Hayır, vermedi” dedi. Rasûlullah sallallahu aleyhi ve sellem, “Öyle ise onu iade et” buyurdu. [302]
“Çocuklarınız arasında eşit muamele yapınız. Oğullarınız arasında eşit muamele yapınız.” [303]
“Kocasının izni olmadan bir kadının (kendi malından) bağışta bulunması caiz değildir” buyurdu. [304]
“Umrâ caizdir.” [305]
“Bir kimse (çalınan) malının aynını bir kimsenin yanında bulursa onu almaya hak sahibidir. (Hırsızdan) satın alan kimse, parasını satıcıdan alır.” [295]
Rasûlullah sallallahu aleyhi ve sellem “Hayır, örfe göre harcamanda sana bir güçlük (günah) yoktur” buyurdu. [296]
“Sana emanet edene emanetini öde. Sana hiyanet edene hiyanet etme.” [297]

"(Do not make) umra (pilgrimage). Whoever gifts property with a condition that it is essential for life, then that property remains under his control and enters into the inheritance distribution.” [309]
Katadah said: Then Hasan forgot and said: “He is your trustee. He cannot be borrowed from.” [310]
“Indeed, the Mighty and Majestic Allah gives every right to its owner. There is no bequest to an heir. A woman cannot distribute anything from her home without her husband’s permission.” They said, "O Messenger of Allah, what about food?" The Messenger of Allah, peace and blessings be upon him, said: “Food is the most virtuous of our possessions.” Then he said, “Borrowed items are repaid. Meniha (land, livestock, or trees taken to yield their produce) is returned. Debts are paid. A guarantor is responsible for the debt.” [311]
“Eat,” he commanded. He kept the servant who brought the food and the dish waiting until they were finished eating. Then he gave the sturdy plate to the servant. He left the broken plate in his home. [312]
The camel of Bara bin Azib entered someone’s garden and damaged it. Consequently, the Messenger of Allah, peace and blessings be upon him, ordered that during the day, property owners protect their properties, and at night, animal owners protect their animals. [313]
