LEASE SECTION · 85 – THE CASE OF A DONOR WHO GIVES MORE PROPERTY TO SOME CHILDREN THAN OTHERS














Narrated Numan ibn Bashir: My father gifted me some property. The narrator Ismail ibn Salim said that he gifted a slave. My mother, Amra bint Rawaha, told my father, "Go to the Messenger of Allah (peace and blessings be upon him) and let him witness this gift." So my father came to the Messenger of Allah (peace and blessings be upon him) and informed him about the gift he had made to me, his son Numan, and my family, Amra, asked him to bear witness to it.
The Messenger of Allah (peace and blessings be upon him) said: "Do you have any other children besides Numan?" My father said, “Yes.” The Messenger of Allah (peace and blessings be upon him) said, "Have you given them as much as you gave to Numan?” My father replied, “No.”
Some narrators report that the Messenger of Allah (peace and blessings be upon him) said, “This is injustice,” while others report that he said, “This is coercion; let someone other than me witness it.”
In a narration related by Mughira ibn Shu’ba, the Messenger of Allah (peace and blessings be upon him) said: "Would you not like your children to treat you with kindness and generosity in the same way?" My father replied, “Yes.” The Messenger of Allah (peace and blessings be upon him) then said, “Let someone other than me witness it.”
In a narration related by Mujahid, the Messenger of Allah (peace and blessings be upon him) said: "It is incumbent upon your children to treat you justly among them, just as you have rights over them."
Abu Dawud says regarding the hadith narrated by Zuhri: Some say, “Did you give it to all your sons?” Others say, “Did you give it to all your children?”
Regarding a narration from Ibn Abi Halid Sha’bi: He said, "Do you have any other sons besides Numan?"
In the narration of Abu Dhuha from Numan ibn Bashir: He said, "Do you have any other children besides Numan?"



Narrated by Numan bin Bishr:
His father gave him a slave. The Messenger of Allah ﷺ asked him, "Who is this slave?" Numan said, "This is my slave. My father gave him to me." The Messenger of Allah ﷺ said, “Did your father give like that to all your brothers?” Numan said, “No, he did not.” The Messenger of Allah ﷺ said, “Then return it.”


Numan ibn Bishr, may Allah be pleased with him, narrated that the Messenger of Allah, peace and blessings be upon him, said: "Treat your children equally among yourselves. Treat your sons equally among yourselves."






Jabir (may Allah be pleased with him) narrated:
The wife of Bashir said to her husband, "Gift your slave to my son and ask the Messenger of Allah (peace and blessings upon him) to witness this transaction for me." Then Bashir came to the Messenger of Allah (peace and blessings upon him) and asked him to witness his gifting a slave to his son, [the daughter of] Fulān (Amra, the daughter of Rawāha). And he said to him, "Ask the Messenger of Allah (peace and blessings upon him) to be my witness." The Messenger of Allah (peace and blessings upon him) then asked Bashir, “Does Numan have a brother?” Bashir replied, “Yes.” The Messenger of Allah (peace and blessings upon him) said, “Have you given to them all as you gave to Numan?”
Bashir said, "No, I have not." The Messenger of Allah (peace and blessings upon him) said, “This is not proper. I only bear witness to that which is just.”
