LEASE SECTION · 55 – MAKING TWO SALES WITHIN ONE SALE
Abu Hurayrah, may Allah be pleased with him, narrated that the Messenger of Allah, peace and blessings be upon him, said: “Whoever conducts two sales in one transaction, then for the seller is either the cheaper of the two or riba.”
EXPLANATION
Conducting two sales in one transaction has been explained in various ways.
Firstly, a person says to the buyer, "I sold this commodity to you for one hundred lira upfront and one hundred fifty lira on credit," and they separate without agreeing which price is intended, then the seller is prohibited from that sale. It is advised that the seller accept having sold at the lower price, acknowledging that he has taken less, and if he takes payment at the higher price, he will fall into riba.
Secondly, a person says, "I have sold this commodity to you for one hundred lira, but on the condition that you sell me your commodity for fifty lira." In this case as well, it is prohibited because there are two conditions in one sale. Both of these types of sales fall under *bay’i fāsida* (void sales).
