CASE FILES · 10 – RENDERING A JUDGMENT AMONG THE PROTECTED


According to the narration of Ibn Abbas (may Allah be pleased with him), he said:
The verse from Surah al-Ma'idah [5], verse 42, “If those who have contracts come to you for judgment, then judge between them according to what is just,” and the verse, "Judge between them by what Allah has revealed," in the same surah, verse 47, have abrogated each other.





According to the narration of Ibn 'Abbas (may Allah be pleased with him), he said: “At the time when the verse ‘If those who have taken refuge with you come to you for judgment, then judge between them justly’ was revealed, the Banu Nadir killed someone from the tribe of Qurayza and paid half a diyah (blood money). When the tribe of Qurayza killed someone from the Banu Nadir, they paid the full diyah. The Messenger of Allah (peace and blessings be upon him) equalized the obligations of both tribes.”
